Accusations of Child Molestation Are Not Evidence of Child Molestation
A relationship ends. A divorce or separation becomes a battle. An embittered mother accuses a father or boyfriend of molesting her children, hoping to use it to gain the upper hand in a custody battle. This scenario is surprisingly common. Thankfully, accusations of this type and all other types, even though they do cause a great deal of damage, are not evidence that a crime was committed.
In order to be convicted of child molestation, prosecutors must be able to prove beyond a reasonable doubt that the crime was committed. A sworn statement by a mother or child may be probable cause to charge someone of the crime, but it is not enough to convict. The accused has the right to confront the accuser in a courtroom in order to show the falsity of the accusation.
